Booking Terms

We are excited for you to use Therapist Point, and we truly hope you enjoy the experience. Before you start using our platform, please take a moment to review the important information outlined in this document.


These terms and conditions (the "Terms of Use" or the "Agreement") form a legally binding agreement between you and Therapist Point (U Solutions LLC) ("Therapist Point," "we," or "us"), the operator of Therapist Point.com and its associated websites, applications, services, and mobile platforms (collectively referred to as the "Services"). These Services are offered by Therapist Point, and the Terms of Use are applicable to all content and functionalities provided through these platforms.


Certain Services may require you to accept additional terms, which will be made available to you before you use those specific Services and will be considered part of this Agreement. For clarity, the "Services" include, but are not limited to, scheduling pages provided by Therapist Point for third-party providers, appointment scheduling tools embedded in third-party websites, and video services for telehealth appointments.


This Agreement forms a binding contract between you and Therapist Point, outlining the terms that govern your access to and use of our Services. By accessing or using our Services, you agree to comply with all the terms and conditions set forth in this Agreement. If you do not agree, you are not permitted to use the Services. In this Agreement, the term “you” refers to any visitor, user, or individual who accesses our Services, whether or not they have registered for a Therapist Point Account (as outlined in Section 1).


If your access to the Services is terminated for any reason, the following will apply: (a) this Agreement will remain in effect and enforceable with respect to your previous use of the Services (including any unauthorized use of the Services thereafter), and you will still be bound by your indemnification obligations as described in this Agreement; and (b) any rights or licenses granted to us under this Agreement will continue to be valid even after termination.


Therapist Point’s collection and use of your Personal Data in connection with the Services is detailed in our Privacy Policy (as defined therein).


Important: please carefully review the arbitration clause and class action waiver in section 17.1 below, as it requires you to resolve any disputes between you and therapist point through binding, individual arbitration. By agreeing to these terms, you understand and accept that both you and therapist point waive the right to a jury trial. You also acknowledge and agree that you waive your right to participate as a plaintiff or class member in any class action or representative proceeding against therapist point. By entering into this agreement, you confirm that you have read, understood, and agree to be bound by all the terms and conditions, and you have considered the impact of this decision.


As we continuously strive to improve our Services, these Terms of Use may need to be updated to reflect changes in our offerings. We reserve the right to modify these Terms at any time, and if we do so, we will notify you by posting a notice on our site, sending you an email, and/or using other communication methods.


If you do not accept the updated Terms of Use, you may choose to reject them, but this will mean you will no longer be able to use the Services. If you continue using the Services after the changes to the Terms take effect, you are considered to have agreed to the updated terms.


Any disagreements related to this Agreement will be governed by the version of the Agreement in place at the time the issue first arose. Unless otherwise specified, no changes or updates to these Terms will be valid unless they are made in writing and signed by both you and Therapist Point.


We may periodically add new features to the Services, replace current services with new ones, or discontinue certain parts of the Services. Therapist Point will not be held responsible for any suspension or termination of any Services, and the use of any new services or features will be subject to the terms of this Agreement.


If you set up a Therapist Point Account or use the Services on behalf of someone else or an organization, you confirm that you have the authority to agree to these Terms on their behalf and legally bind them to this Agreement. In this case, any references to "you" and "your" in this Agreement (excluding this sentence) will apply to that individual or entity.


By agreeing to these Terms of Use, Therapist Point grants you a limited, non-exclusive, revocable, non-transferable license to access and use our Services as described here. You can view some parts of the Services without an account, but to fully take advantage of all features, you must create a Therapist Point Account and provide certain basic details about yourself. By providing this information, you authorize Therapist Point to use and disclose it according to our Privacy Policy. While using the Services, you may come across various types of Content made available by Therapist Point. "Content" refers to a wide range of materials, including text, images, video, data, advice, articles, availability schedules, and other information provided through the Services. Although some of this Content may be offered by healthcare professionals, it should not be considered a substitute for professional medical advice, diagnosis, or treatment. It is intended to help you find healthcare providers or offer general information. Although we strive to provide accurate content, we make no representations or warranties, express or implied, about the content, including but not limited to professional qualifications, work quality, costs, or insurance information. Under no circumstances will we be liable for any decision or action you take based on the content. We do not endorse or recommend any particular individual or entity featured in the content or available through the services.


Therapist Point is not a healthcare provider. The information and content you receive through our platform, whether from employees, contractors, partners, or advertisers, is purely for informational and scheduling purposes. This includes content found in our Knowledge Base, blog, social media, emails, and advertisements. While we hope the content we provide is helpful, it is not intended to replace or substitute professional medical advice, diagnosis, or treatment. If you are dealing with a medical emergency or a mental health crisis, or if you are considering self-harm, call a medical professional or dial 911 immediately. You use the services at your own risk. Nothing on our platform should be considered as practicing medicine, dentistry, nursing, or any other healthcare practice. Therapist Point does not act as a referral service, nor do we recommend or endorse any specific healthcare provider, treatment, procedure, or other information presented through the Services. Any reliance you place on the Content is entirely at your own risk. We advise you to verify any relevant information through other sources, including the provider's office, professional medical associations, or licensing boards.


Therapist Point urges Healthcare Providers to use the Services in a responsible manner, but we do not have control over their availability or guarantee that they will be accessible at specific times. We are not responsible for any canceled or missed appointments, nor for any resulting injuries or losses. Furthermore, we disclaim any liability for other damages or losses that may arise from your use of the Services.


You are responsible for choosing a healthcare provider based on their specialization, experience, and qualifications. Therapist Point verifies that providers hold required licenses and are not excluded by the U.S. Department of Health and Human Services. We may remove providers for inappropriate behavior.


While providers can choose to participate, our list is not exhaustive, and some may have additional availability if contacted directly. Providers may also pay for marketing or access to the platform.


We provide lists and profiles based on your preferences, but keep in mind that other suitable providers may not be listed on Therapist Point.


Therapist Point (a) does not employ, refer, recommend, or endorse any Healthcare Providers, (b) does not guarantee the quality or accuracy of services they provide, (c) is not responsible for verifying the accuracy of a provider's information, (d) does not ensure the quality of services provided, and (e) does not charge Healthcare Providers for better placement in search results (except for Sponsored Results, as noted below). We do not control Healthcare Providers' actions, and they are not our employees. If you use the Services through your employer, the provider lists may be influenced by employer-specific criteria.


We may display Sponsored Results within the search results, which are paid for by Healthcare Providers. These are clearly marked as “Sponsored” or “Paid Ad” and should not be seen as an endorsement by Therapist Point.


The Services provided by Therapist Point are intended to be informational and educational for both consumers and Healthcare Providers. While we may publish Content reviewed by our editorial team, we are not obligated to do so and make no guarantees about the accuracy, timeliness, or completeness of the Content. We are not liable for any errors, omissions, or outcomes resulting from the use of this Content.


Healthcare Provider Content:


Content about Healthcare Providers and their practices ("Healthcare Provider Content") is for general reference only. It may be provided by the Healthcare Provider, their staff, or collected from various sources, which may not always be verified. While we strive to keep this information current, it may become outdated or inaccurate at any time. Therapist Point does not certify or offer advice regarding any provider's qualifications.


Procedures/Products/Services:


Information about procedures, products, services, and devices shared through the Services may not apply to everyone or every situation. Advertisements or content from sponsors may not indicate the safety, appropriateness, or effectiveness of these items for any individual.


Insurance Content:


Insurance-related information ("Insurance Content") is provided for general reference and convenience. It may be based on data you provide, as well as Healthcare Provider Content, and can change frequently. While we aim to provide accurate information, we are not responsible for inaccuracies or outdated content. You agree to provide accurate insurance details and ensure they remain current.


You may choose to enter medical information into the Services, such as requesting an appointment or completing a general medical history form ("Medical History Form"), either for yourself or a third party with their authorization. You can authorize Therapist Point to share this information with your selected Healthcare Provider. You agree that the information will be reviewed and approved by you or an authorized individual at the time of your appointment for accuracy. Additionally, you acknowledge that Therapist Point may use the data provided in the Medical History Form in accordance with our Privacy Policy.


Using our website is free, but you are still responsible for any healthcare-related expenses. Charges for medical services provided by Healthcare Providers are your responsibility. It’s important to ensure all information you provide to Therapist Point, including insurance details, is accurate and current. Some Services may not be available based on factors like your insurance coverage, and you must resolve any disputes with Healthcare Providers directly.


You are responsible for all use of the Services and your Credentials, including by anyone you share them with. The Services must only be used for lawful, non-commercial purposes. If applicable laws prohibit your use, you are not authorized to access the Services. You may not misuse the Services to damage, overload, or interfere with our networks or others' use of the platform, nor attempt unauthorized access to any system or network. Additionally, you may not collect or index any Content from the Services for any purpose. In addition to our rights in these Terms of Use, we may take any legal action and implement any technological measures to prevent violations of the restrictions hereunder and to enforce these Terms of Use, our Acceptable Use Policy, and our Community Standards.


If you are a Healthcare Provider or involved in the healthcare or medical industries, regardless of whether you have a Therapist Point Account or plan to use the Services to schedule appointments, you agree that:


(a) You will only use the Services to view or access price, availability, or other content for personal use as a patient or prospective patient; (b) You will not use the Services to establish or attempt to establish agreements related to pricing, service offerings, or customer allocation, or engage in price fixing, output restrictions, or market division; (c) You will not use the Services to engage in deceptive, unfair, or anti-competitive practices, including booking fraudulent appointments or manipulating review data, or violate any relevant antitrust, competition, or consumer protection laws.


If a dispute arises between users or between a user and a third party (including but not limited to Healthcare Providers) through the Services, you agree that Therapist Point is not obligated to intervene. In the event of such a dispute, you release Therapist Point, its directors, employees, agents, and successors from any claims, demands, or damages of any kind, whether known or unknown, suspected or unsuspected, related to or arising from such disputes and/or our Services.


You may be able to access certain telemedicine services through the Services, such as Therapist Point’s video service or third-party virtual care options (“Video Services”). Therapist Point is not a healthcare provider, insurance provider, or prescription fulfillment service. Our role is limited to facilitating access to telemedicine services offered by Healthcare Providers and providing related information. We are not responsible for the actions or omissions of these providers, or the content of your communications with them. Therapist Point operates independently from Healthcare Providers and does not control their services. Additionally, we are not responsible for the content, availability, accuracy, quality, or privacy practices of any third-party Video Services. We recommend reviewing the terms and privacy policies of third-party providers. By using these services, you release Therapist Point from any liability related to their use.


While using the Services, you may come across links to third-party websites. These links are provided for convenience, and we do not endorse the sites or the products/services they offer. We are not responsible for the content or accuracy of these external websites and cannot be held liable for any objectionable, unlawful, or inaccurate material they may contain. By using the Services, you release us from any liability related to your use of these third-party sites or services. Any transactions or interactions you have with organizations or individuals through the Services are solely between you and them. You should investigate these third parties before engaging in any transactions.


We may use third-party software, including open-source software, as part of the Services. Your use of such software is subject to any additional terms set by the third-party provider.


The availability of our mobile application depends on third-party stores like the Apple App Store or Google Play. These stores may have their own terms, which you agree to when downloading the app. You must comply with those terms, and where they conflict with our Terms of Use, our terms will apply.


If you use the Services through an application, you acknowledge that these Terms of Use are between you and us, not the application provider. We are responsible for the application, not the provider. The app is licensed to you for use with the Services, subject to these Terms of Use. If using an Apple device, the app is only to be used with a device you own or control. The app provider is not responsible for maintenance or warranty claims, but if the app fails to meet applicable warranties, the provider will refund the purchase price, if any. We are responsible for addressing claims related to the app, and you must comply with any applicable third-party agreements. The application provider and its subsidiaries can enforce these Terms of Use as third-party beneficiaries. If the app infringes on intellectual property rights, we will handle any claims, not the application provider. Lastly, you confirm you're not in a restricted country or on a prohibited list.


You can use the Services to pay for Healthcare Provider services, including copayments and other fees. Payments are processed according to our Privacy Policy, and a transaction fee may apply. Healthcare Providers may list prices for their services ("Designated Provider Services"), which you can pay for through the platform.


Before scheduling, review the price details and services included. Providers must charge the listed price unless otherwise agreed. Therapist Point is not responsible for pricing disputes or additional service agreements.


For insurance payments, we aim for accuracy but make no guarantees. You are responsible for any remaining amounts not covered by the Insurance Payment Services.


When using the payment services, you are responsible for the Designated Price and any additional charges, and you must fulfill all legal obligations, such as copayments or deductibles. Payments are processed through our partner, Stripe, which may charge a processing fee. Therapist Point is not liable for charges from Healthcare Providers, and any disputes must be resolved directly with the provider. You should promptly review charges and notify us of any issues within 12 months. Additionally, it's your responsibility to keep your billing information up-to-date. We are not liable for errors by the payment processor, and transactions may fail due to issues like incorrect payment info, insufficient funds, or account suspensions.


You may submit feedback and reviews about your experience with Healthcare Providers through Therapist Point, as well as participate in other community features. However, your submissions must comply with our Acceptable Use Policy and guidelines. While we may moderate content, we do not endorse or confirm the accuracy of any posted information, which reflects only the views of the author. By posting, you grant Therapist Point a worldwide, irrevocable, royalty-free license to use, modify, and distribute your content, ensuring it doesn't infringe on third-party rights. We are not liable for any posted content or related claims. Additionally, any feedback you submit is considered non-confidential, and you grant us a perpetual, royalty-free license to use it as we see fit. All content on Therapist Point is our property or that of our licensors, protected by intellectual property laws. You may use it for personal, non-commercial purposes only. Lastly, while we aim to improve your experience, we are not responsible for how you use or interpret the content, nor for any actions taken as a result of using our services.


Your sole remedy for any dispute with Therapist Point is to cancel your account. Our liability for any claims related to your use of the services will not exceed $100 or the total amount you paid in the six months prior to the event leading to the claim.


To the fullest extent allowed by law, Therapist Point is not liable for any indirect, special, incidental, punitive, or consequential damages arising from your use of the services. This includes lost profits, data, goodwill, or issues with healthcare providers, even if we knew such damages were possible.


You waive rights under California Civil Code Section 1542, which protects claims that were unknown at the time of a release. We may terminate, suspend, or deactivate your account at our discretion, without notice, for violations of our policies, inactivity, or any other reason. We are not liable for any loss resulting from account termination.


You agree to indemnify Therapist Point for any liabilities or claims related to your use of the services or breach of this agreement. We may investigate and take legal action against policy violators, including removing offending content or terminating accounts.


Disputes must be resolved through arbitration in New York, and claims will not be combined with those of others. You can opt-out of arbitration by sending notice within 30 days. Any action must be brought within one year of the dispute, and if any part of this agreement is found invalid, the rest remains enforceable.


This agreement is governed by New York law, and it includes all related policies. If we transfer this agreement to another entity, you cannot assign it to anyone else. You must be 18 or older to use the services; those under 13 cannot use it. If you are a guardian, you represent that you have the authority to use the services on behalf of a minor.


Use of the services outside the U.S. is prohibited, and users must comply with applicable local laws.
